For the political prisoners in Nicaragua

On October 4, 2022, the Inter-American Court of Human Rights (IACHR) issued provisional measures in favor of forty-five people deprived of their liberty by the State of Nicaragua, considering that their life, personal integrity and , health and food.

Based on the proposals made by the Inter-American Commission, the IACHR considered that the situation should be inscribed in the general Nicaraguan context that began in April 2018 due to the protests against the Government. And that for this reason protective measures were issued in the “Matter of seventeen persons deprived of liberty”, in order to protect various leaders against the arrests made. In October 2019, in the “Assertion of Members of the Nicaraguan Center for Human Rights and the Permanent Commission on Human Rights (CENIDH-CPDH)”, measures were adopted to protect the life and integrity of the members of these two non-governmental organizations.

In the “Juan Sebastian Chamorro et al” case, the Court issued five resolutions for provisional measures –and the presidency one resolution for urgent measures—, considering the risk and vulnerability of people identified as opponents of the Government of Nicaragua. In issuing these latest orders, the Court considered that, in the context of the elections held in 2021, the arrests sought to intimidate, dissuade or silence other political opponents. An extremely relevant aspect of the resolution is that the specific situation of each of the people benefiting from the measures was detailed. That is, the circumstances of detention, the location and conditions in the corresponding center, etc.

The measures granted consisted of requiring Nicaragua to proceed to release them immediately, effectively protect their life, health, access to food, integrity and personal freedom; facilitate their periodic contact with relatives and lawyers during the processing of their release. Regarding the relatives of the detainees, the IACHR ordered the adoption of measures to effectively protect their life, integrity, and personal liberty, as well as to eliminate checks and searches that violate both the privacy and the dignity of adult and minor visitors during the processing of releases.

The beneficiaries of the measures are John Cristopher Cerna Zuniga, Fanor Alejandro Ramos, Edwin Antonio Hernandez Figueroa, Victor Manuel Soza Herrera, Michael Rodrigo Samorio Anderson, Nestor Eduardo Montealto Nunez, Francisco Xavier Pineda Guatemala, Manuel de Jesus Solvarro Bravo, Richard Alexander Saavedra Cedeno , Luis Carlos Valle Tinoco, Victor Manuel Diaz Perez, Nilson Jose Membreno, Edward Enrique Lacayo Rodriguez, Maycol Antonio Arce, Maria Esperanza Sanchez Garcia, Karla Vanessa Escobar Maldonado, Samuel Enrique Gonzalez, Mauricio Javier Valencia Mendoza, Jorge Adolfo Garcia Arancibia, Leyving Eliezer Chavarria, Carlos Antonio Lopez Cano, Lester Jose Selva, Eliseo de Jesus Castro Baltodano, Kevin Roberto Solis, Jose Manuel Urbina Lara, Benjamin Ernesto Gutierrez Collado, Yubrank Miguel Suazo Herrera, Yoel Ibzan Sandino Ibarra, Jose Alejandro Quintanilla Hernandez, Marvin Antonio Castellon Ubilla , Lazaro Ernesto Rivas Perez, Gustavo Adolfo Mendoza Beteta, Denis Antonio Garcia Jiron, Danny de los Angeles Garcia Gonzalez, Steven Moises Mendoza, Wilber Antonio Prado Gutierrez, Walter Antonio Montenegro Rivera, Max Alfredo Silva Rivas, Gabriel Renan Ramirez Somarriba, Wilfredo Alejandro Brenes Dominguez, Marvin Samir Lopez Namendis, Irving Isidro Larios Sanchez, Roger Abel Reyes Barrera, Jose Antonio Peraza Collado and Russia Evelyn Pinto Centeno.

In the resolution in question, it was established that before October 18 of this year, Nicaragua must inform the Commission of compliance with the measures –as well as submit a monthly report on the corresponding progress—. We are one week away from the government of Daniel Ortega deciding what its commitment is to the system of rights and guarantees that the inter-American community has decided will govern the conduct of its authorities to protect the dignity of its populations. With this resolution, the highest body of this system gives you a new opportunity to define yourself. We will soon know if he did it and, above all, how he executed it.
